Judge determines evidence from Deborah Eck’s home too old

A judge deemed the evidence collected from Deborah Kay Eck’s Phippsburg-area home inadmissible during a hearing Monday morning, prompting prosecutors to drop the charges of marijuana cultivation. Judge Michael O’Hara III ordered that the items gathered in the search of Eck’s Phippsburg-area home — a reported 58 marijuana plants — were not admissible as evidence because the search warrant used to collect them used “stale” information.

Eck’s marijuana case continued

Deborah Kay Eck, the 61-year-old Phippsburg woman accused of growing marijuana in her home outside of Yampa, appeared in Routt County Court for the first time Tuesday. County Judge James Garrecht set a status conference for 2 p.m. Feb. 10.
