ORDINANCE NO. 611

AMENDMENT TO ORDINANCE 582 RE: WATER AND SEWER TAP FEES

BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OAK CREEK:



Section 1. Amendment. Section 13.04.010 Connection Charges – Water shall be amended to read as follows:

13.04.010 Connection Charges-Water.



D. Water taps are attached to the real property of issue and are not transferrable to another property.

E. Water taps are non-refundable.

F. The owner of unconnected water taps, after five years from purchase date, will be required to pay any additional difference in the current cost at time of connection.

Section 2. Amendment. Section 13.04.020 Connection Charges – Sewer shall be amended to read as follows:

13.04.020 Connection Charges-Sewer.

F. Sewer taps are attached to the real property of issue and are not transferrable to another property.

G. Sewer taps are non-refundable.

H. The owner of unconnected sewer taps, after five years from purchase date, will be required to pay any additional difference in the current cost at time of connection.

Section 3. Amendment. 13.24.060 Extension of electric service facilities shall be amended to read as follows:

13.24.60 Extension of electric service facilities

D. Electric facility investment fees are attached to the real property of issue and are not transferrable to another property.

E. Electric facility investment fees are non-refundable.

F. The owner of unconnected electric taps, after five years from purchase date, will be required to pay any additional difference in the current cost at time of connection.

Section 4. Severability. If any parts, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of this Ordinance.

Section 5. Effective Date. This Ordinance shall take effect in accordance with the manner prescribed by law.
