No felony charges filed against Oak Creek woman

— After reviewing the evidence, the Routt County District Attorney's Office has chosen not to file felony charges against an Oak Creek woman who was arrested Sunday night on suspicion of violating a protection order, resisting arrest and second-degree assault of a peace officer.

Melissa Jean Rainey-Schamanski, 34, has been charged with misdemeanor resisting arrest, driving under the influence and violating a protection order.

Undersheriff Ray Birch said the woman resisted arrest and scratched the deputies with her fingernails as they attempted to handcuff her. Birch said the woman then repeatedly banged her head against the cage of the patrol car she was placed in after deputies closed the door, which caused her head to bleed. According to the arrest affidavit, she then attempted to spit blood at the deputies.

Because less severe charges were filed, Rainey-Schamanski's bond was lowered from $10,000 to $1,500 during court Wednesday. She remained in custody and is next scheduled to appear in court July 27 at 8:30 a.m.
