Oak Creek considers annexation of newly purchased property

— The Oak Creek Town Board on Thursday will consider the first step in the annexation process for a piece of land it has agreed to buy.

During meetings earlier in 2014, the Town Board considered the purchase and eventually made the decision Feb. 13 to buy the land for $105,000.

As part of the purchase agreement, the seller, Golden Stream Investments, will take the property through the town’s annexation and subdivision process before the sale closes.

On Thursday, the Town Board will consider whether the annexation petition is in compliance and can move forward. The annexation process includes multiple meetings of the Town Board and Planning Commission before a public hearing May 8 and the final decision by the Town Board at its second meeting in June.

The sale is slated to close July 31, Town Administrator Mary Alice Page-Allen said.

The 9.5-acre parcel that borders the town’s public works department currently has a mini-storage facility on about an acre of the property, which Golden Stream Investments will retain.

The remaining 8.5 acres that Oak Creek is purchasing will be split into two similarly-sized parcels.

Page-Allen said that only part of the land is needed for the eventual expansion of the public works department and that discussion only just has started about what to do with the remaining parcel.

When annexed into Oak Creek, the land will be in Performance District 4, which allows activity such as the mini-storage facility as a conditional use.

Page-Allen said the town will propose using the existing county permit for the business as the basis for allowing the use to continue in the town.

When the mini-storage facility initially was developed, Page-Allen said, the town was involved in the county’s review and approval of the project, and there was a condition that any further development on the property also had to come back to the town.

“It only makes sense for us to have property like that within the town,” she said. “That is a designated growth area slated for potential annexation in the town comprehensive plan.”

As Golden Stream was only interested in the mini-storage facility, Page-Allen said, the discussion about what to do with the rest of the property came up before it was acquired from First National Bank of the Rockies for $105,000 in September 2013.

Based on the outcome of the town’s work on its capital improvement plan in late 2013, Page-Allen said she brought up the idea of the town purchasing the property with Golden Stream and informally with the Town Board. Members of the Town Board instructed her to pursue the idea, she said.

“We certainly want to have property that we own and oversee within the town boundaries,” Page-Allen said.

I am concerned that the town is so obviously saying acres can be annexed without even a plan for the annexed parcel as long as it is town owned land. But when a private property owner seeks annexation then there is a completely different criteria.

And you have to congratulate connected people. The new owners buy it cheap from the bank because the only value is the storage units. Oak Creek has a long history of making it long and expensive to seek annexation. Owner is supposed to provide water rights for all development and so on.

But now, the Town is paying the same for part of the parcel as what Golden Stream paid for the entire parcel and annexing the entire thing into the town and ignoring all of the requirements of past annexations.
