— A brawl last week between a group of Kansans and Texans has resulted in one arrest.

A 24-year-old Texas man was arrested Saturday night on suspicion of second-degree assault related to a fight that occurred two nights previous in Torian Plum Plaza at the base of Steamboat Ski Area.

Cody Austen Geldard admitted to police that he kicked a man in the head during the fight, according to a court affidavit completed by Steamboat Springs Police Department Detective Jerry Stabile.

“Cody said he was sorry he kicked the guy and said that he knew it was wrong,” Stabile states in the affidavit.

Police seized Geldard’s steel-toed boots that he said he was wearing during the fight.

According to the affidavit, the owner of a nearby business witnessed the fight and told police, “The guy kicked the man that was on the floor with such force that blood spattered on his pant leg.”

Kris Rubio, 27, was identified as the victim. He originally is from Kansas but now lives in Penrose, Stabile said. Rubio was treated at Yampa Valley Medical Center for multiple facial fractures he sustained during the fight, which took place early Friday. He was released from YVMC later Friday.

Police think members of the two groups of people visiting Steamboat for MusicFest had gotten into another fight earlier that night, also in Torian Plum Plaza.

Police did not identify Geldard as a suspect until Saturday, when a friend of the victim saw him at the MusicFest tent and called police.

Stabile said Tuesday that the incident still is under investigation and others may be arrested.

As of Tuesday morning, the Routt County District Attorney’s Office had not filed charges against Geldard. He was released Monday afternoon after posting $10,000 bond and is due to return to court at 8:30 a.m. Jan. 24.

A message left with a Steamboat attorney thought to be representing Geldard was not immediately returned Tuesday.

so for the sake of the "almighty" dollar we allow these reckless, drunk, and violent people to come here to party in a parking lot with a big tent and a selective music style (as we all can hear at night_ when locals are normally enjoying the peace and quiet of the valley)...hummm is it really worth it???...they don't tip and they trash condos...I have heard of a few places saying they will boycott "Music fest" next year....maybe its time to find an event that EVERYONE can enjoy- not just a select group. Even the tourists (who are here for the Steamboat experience) avoid this group...that's sayin' something!!!

I don't understand the mentality of someone who would kick another human being in the head. It should be considered attempted murder; there is no other way to view it, IMO. When a guy kicks someone in the head (with steel-toed boots, no less!!!!) what the hell kind of outcome does he expect?? I agree, 1999. I hope they throw the book at him.

oh come on he said he was sorry and knew it was wrong..just another thug..throw the book atem along with the other thug from a couple weeks ago..pay restitution, medical bills, time in jail fines anger management and alcohol classes..i agree phoebe it should be considered attempted murder..anyone who kicks someone when they are all ready down(especially in the head) needs to be locked up and have the key thrown away

A man is down,so this guy kicks him, viciously,in the head. What a coward! He knew it was wrong? Apparently he is not man enough to turn himself in,but had to be caught because he was too dumb to leave the area after committing his assault He was probably pleased with himself, until he got arrested. I hope they get anyone else who was involved and punish them as much as they deserve. Too much liquid courage flowing that night.

Wearing steel toes in the winter, out to a bar, when you have not been working? I hope they add "assault with a deadly weapon" to his charges.

Random fact ... Geldard is from Magnolia, TX, a podunk town with a population of about 1300 and 74 registered sex offenders. Seventeen registered sex offenders per person. Holy shamoley.
