TOWN OF OAK CREEK ORDINANCE NO. 612
AN ORDINANCE AMENDING ORDINANCE NO. 603, AN ORDINANCE AMENDING THE OAK CREEK MUNICIPAL CODE TO REQUIRE A LICENSE TO OPERATE A BUSINESS OR COOPERATIVE THAT SELLS OR DISPENSES MEDICAL MARIJUANA PURSUANT TO THE AUTHORITY GRANTED BY ARTICLE XVIII, SECTION 14 OF THE COLORADO CONSTITUTION
Section 1. Amend. Section 2 shall be amended to read as follows:
Applicable Fees:
An Applicant shall pay to the Town a non-refundable application fee in the amount of $2500.00 when the application is filed. The purpose of the fee is to cover the administrative costs of processing the application. The amount of the application fee shall be fixed by the Board of Trustees as part of its annual budget process.
Applicant will pay for the required background check and fingerprinting
Applicant shall be responsible for a $1500.00 fee for initial inspection of the premises
The annual license renewal fee shall be $1000.00
The annual inspection fee which shall accompany license renewal shall be $1000.00
Re-inspection fee for non compliance ANY TIME DURING THE YEAR shall be $1000.00
There will be no charge to Business that sells or dispenses medical marijuana for random checks or at the time a complaint is made if non-compliance is not proven
Section 2. Severability. If any part or parts, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of this Ordinance.
Section 3. Effective Date. This Ordinance shall take effect in accordance with the manner prescribed by law.
INTRODUCED, READ, ADOPTED and ordered published as provided by law by the Board of trustees for the Town of Oak Creek at its regular meeting held on the 14th day of July, 2011.
