— Marco Serge Pauvert, 55, owner of The Epicurean restaurant in downtown Steamboat Springs, was arrested Wednesday on suspicion of indecent exposure. The incident was reported just before 4 p.m. Sgt. Rich Brown, of the Steamboat Springs Police Department, said a woman went into the restaurant that afternoon to talk to Pauvert about a business matter.

“At some point after she had been over there for a while, she reported that he allegedly exposed himself to her and then she came in and reported it straight to investigations,” Brown said.

Police went to the restaurant and spoke with Pauvert, Brown said. Based on that conversation, Brown said, they arrested him on a charge of exposing the genitals, a misdemeanor. Brown said there were no allegations of physical contact.

“I am innocent and justice will be served,” Pauvert said Friday.

Jeffery Weeden, of Feldmann Nagel Brauchler & Weeden, the firm representing Pauvert, said he would reserve specific comments until the conclusion of the case.

“We can’t comment on the facts of the case, but we are prepared to vigorously defend Mr. Pauvert against the allegations,” Weeden said. “We’re going to work hard to ensure that it’s a fair and just process.”

Pauvert was arrested in June 2005 after a neighbor reportedly saw him walking around nude in his own garage. He was acquitted in 2006 of all three indecent exposure charges he was facing. The same firm represented Pauvert in that case.
