A DUI PerSe is the act of driving with a blood or breath alcohol level in excess of the state limit of .08. (These levels are even more restrictive for people holding a commercial DL and for those under the age of 21.) There are two types of DUI charges, one for the simple act of driving under the influence, the second is the driving in excess of that limit. So when you see the charges DUI & DUI PerSe, that is what it means. Hope this helps.

i may be wrong but i thought the dui charges "breakdown" are as follows: DUI/DWI= over .08 (breatherizer) DWAI (driving while ability impaired)= over .04 DUI per se= one being charged w/ DUI/DWI but the charge is based on the arresting officers opinion yet there is no confirmed proof (b/c one charged refuses breatherizer, roadside & blood alcohol content test)
