Deputy allegedly attacked


— A 46-year-old Oak Creek man faces an assault charge on a peace officer for allegedly attacking a Routt County Sheriff's deputy with a telephone early Friday morning.

Gary Wayne Patro, who was being booked into the county jail, allegedly picked up a telephone receiver and hit a jail deputy in the hand, Routt County Sheriff John Warner said.

"He apparently grabbed the receiver of a telephone on the counter," Warner said. "The deputy did not need to go the hospital and was able to finish the shift."

Patro was arrested by Oak Creek Police for harassment just after midnight. He was being booked into the county jail at about 12:45 a.m. when the alleged assault occurred, Warner said.

Because of Patro's alleged use of the telephone receiver, he destroyed the phone, he said.

Patro faces a misdemeanor charge of criminal mischief because of this.

Patro was advised of the charges later in the day by Routt County Judge James Garrecht. His bond was set at $5,000.
